General Information

Highlighted or bold text indicates a change or addition to previous
rules.

The use of the Lakes in Christmas Lake Village is a privilege granted to Association members, their family, and guest.  To maintain these privileges the following Lake Rules and Regulations must be complied with.  Persons using CLV lakes do so at their own risk.

(A).  “Watercraft” shall mean any device by which an individual can be
transported on water to include, but not limited to, row boat, sail boat, canoe, pontoon, paddle boat, skiff, dinghy, jet skis, and specialty prop-craft.

(B). “Skiing” includes any device which may be towed by a watercraft.

  • Each Motorized Watercraft that is to be used on any lake within Christmas Lake Village must be registered at the Association’s Office.  The registration must be completed each calendar year prior to launching the watercraft within the Village.  A CLV sticker will be affixed by a staff person.  Members/owners of Christmas Lake Village, whose assessments are current on all lots owned, and have no outstanding fees or fines owed to the Village are eligible to register a water craft.  An Indiana watercraft registration or proof of ownership, proof of liability insurance, length of craft, and horsepower rating must be submitted. Owners will be responsible for affixing applicable Indiana water craft numbers in accordance with state guidelines.
  • “Sea Doo’s” or personal watercraft (PWC) owned by a current property owner having a current, valid CLV registration, will be registered for the subsequent year.  Subsequent yearly renewal will be limited to original CLV registered equipment.  No new or additional personal watercraft will be permitted.  Replacement personal watercraft to original registered equipment will not be allowed.
  • Each property owner will be permitted to register two (2) motorized watercraft         per family.  Human powered craft should also be registered for identification purposes.  There is no registration fee.

 

NOTE: For the purpose of these rules, joint property owners shall be considered as one individual property owner.

 

4. Boat dock space will be renewed each year from April 1st-April 30th. Dock reassignment begins on May 1st.  The dock rental fee for April 2008 through April 2009 is $50.00.  First priority will be given to current dock renters.  Second priority will be given to owners that do not have lakefront property.  However, dock space will only be rented to members with CLV registered boats.  No dock space will be rented without a current registration of a boat (A dock space may be reserved with the $50.00 fee for 30 days while a boat is procured.  This arrangement is contingent upon the approval of the Association Manager.  If the reserved period is lapsed, the $50.00 will be returned and the space will be reassigned.)   Docked boats must be registered in the same name as the dock holder. All docks revert back to the control of the Association at the end of the yearly rental agreement.  Only two (2) spaces per property owner can be assigned. For the purpose of these rules, joint property owners shall be considered as one individual property owner.

  • It is against Department of Natural Resources rules, regulations, and State Law to run down waterfowl on any waterways.  Any violators observed will be reported to the DNR for possible prosecution.

 

Types And Sizes Of Boats

 

  • Watercraft with sleeping accommodations such as houseboats, cabin cruisers and the like are prohibited.  Ski kites, water kites, and the like are likewise prohibited.
  • On Christmas Lake, watercraft are limited to a maximum of twenty four (24)

feet in length, and to a maximum of ninety (90) horsepower OUTBOARD motors.  Inboard (with the exception of PWC), and Inboard/Outboard motors are prohibited.

  • On Lake Holly and Lake Noel, watercrafts are limited to a maximum of sixteen (16) feet.  Motors are restricted to electric trolling motors.  Pontoon boats, personal watercraft, and speed boats are prohibited.
  • All watercraft must be registered to CLV property owners or renters. 

“Visiting” boats are prohibited.

 

Lake Rules And Regulations

  • The motor of any watercraft must be stopped during the pick up, loading, or unloading of any person from the water, dock, or beach.

 

  • All watercraft shall be equipped with at least one (1) approved life preserver for the designed capacity of the watercraft. 
  • Each motorized craft shall have a charged fire extinguisher.

 

  • Operators MUST observe the following traffic rules:

 

 (A) All traffic will travel in a counter-clockwise pattern keeping to the right side of the center line buoys and respect the safety zone of twenty five (25) feet on either side of the center buoy line.  Watercraft operating at more than five (5) MPH will stay at least fifty (50) feet from the shoreline and/or docks along the shore line.

(B) When two watercrafts are approaching each other “head to head” or nearly so, each watercraft must bear to starboard (right).

(C) When two boats are approaching each other obliquely, or at right angles, the boat on the right has the right-of-way.

(D) A watercraft may overtake and pass another watercraft on either side if the passing can be done safely within the assured clear distance ahead, but the watercraft being overtaken has the right-of-way.

(E) A watercraft leaving a dock, pier, launching ramp, or shore has the right-of-way over all watercraft approaching the dock, pier, or shore.

(F) All non-motorized craft have right-of-way over all motorized craft.

(G) Boats towing skiers and tubers have the right-of-way over all other motorized craft.

(H) Non-Motorized craft shall endeavor to avoid skiing/tubing areas  during times of high activity.  This in no way nullifies or modifies paragraph “F” of this section.

  • An operator may not create a hazardous wake or wash while approaching or passing another watercraft.

 

  • No watercraft shall be operated in a tight circular course or fashion.
  • An operator may not operate a watercraft in a circular course around a person swimming or around a watercraft in which the occupant is engaged in fishing.

 

  • An operator may not operate a watercraft that is loaded with passengers or cargo beyond the watercraft’s safe (designed) carrying capacity.
  • Operators may not permit any occupants of the watercraft to sit, stand, or lie on the bow decking or the gunwales while the craft is in motion.

 

  • A person may not moor or attach a watercraft to, remove, tamper with, damage or destroy any buoy on the lake.  The area directly between the water valve and the Dam is not a through way and is so marked by buoys.  The dam is considered “shoreline”. (Refer to page 3, item 4A for maximum shoreline speed.)

11. Watercrafts operated by guests are the responsibility of the watercraft owners.

12. Operators of motorized watercraft must possess a valid automobile driver’s license and/or possess proof of satisfactory completion of a certified water safety course.

13. A person may not operate a watercraft while towing a skier, unless each person being towed is wearing a type II, type III, or type V personal flotation device approved by the United States Coast Guard.

NOTE:  Inflatable personal flotation devices do not meet the requirements of this section.

14. A person operating a watercraft equipped by the manufacturer with a lanyard-type engine cutoff switch should attach such lanyard to his/her person, clothing, or personal flotation device as appropriate for the specific vessel.

  •  All watercraft in operation between the hours of sunset and sunrise must have running lights in working condition and turned on.  An agent or employee of a fire rescue, emergency rescue unit, or law enforcement division is exempt from this subsection while performing his/her official duties. 

 

  • All watercraft must, at all times, be operated in a reasonable and prudent manner.  Maneuvers which unreasonably or unnecessarily endanger life, limb, or property shall constitute reckless operation of a vessel and shall include, but are not limited to:

(A) Weaving through congested traffic.

(B) Jumping the wake of another vessel unreasonably or
      unnecessarily close to such other vessel or when visibility around such other vessel is obstructed or restricted.

  • Becoming airborne or completely leaving the water while

crossing the wake of another vessel within 100 feet of the vessel creating the wake.

D) Operating at greater than slow/no-wake speed within 50 feet of an anchored or moored vessel, shoreline, dock, pier, swim float, marked swim areas, swimmer, surfers, persons engaged in angling, or any manually powered vessel.

(E) Operating contrary to navigation rules including following too closely to another vessel, including another personal watercraft.  For the purpose of this subsection, “following too closely” shall be construed as proceeding in the same direction and operation at a speed in excess of 10 mph within 100 feet to the rear or 50 feet to the side of another vessel which is underway, unless said vessels are operation in a narrow channel, in which case personal watercraft may operate at the speed and flow of the other vessel traffic within the channel.

  •  A lake noise ordinance is in effect in Christmas Lake Village.  Shouts, cheers, or excessive noises created by motors, bells, horns, whistles, or other mechanical means are prohibited prior to 7:00 AM, local time and after dusk.  Moreover, extreme excessive noise is strictly prohibited around the clock.  Policing of this ordinance will be complaint driven.  Verification of resident complaints of disruptive noise may result in a fine being imposed on the offenders. 
  • Anchoring your boat, at your own risk, is permitted in cove areas and no wake zones only, 7 days a week.
  • Excluding holidays, anchoring your boat, at your own risk, during daylight hours is permitted in the main channel Monday through Friday ONLY.

 

Speed Limits

  • Maximum speed limit is 35 MPH.
  • Maximum speed limit in all coves and “No Wake Zones” is 5 MPH.
  • Maximum speed for any craft operating between sunset and 7:00 AM is 10 MPH.

Skiing And Tubing

 

  • Boats must have a responsible observer other than the pilot of the watercraft.
  • When possible, turn to PORT (LEFT) to pick up a fallen skier or tuber.
  • Do not follow closer than two hundred (200) feet in the wake of the watercraft

ahead.

  • Watercraft shall not tow more than two (2) people at a time.
  • Tow lines shall not be longer than seventy (70) feet.
  • Towing is not allowed between the hours of sunset and sunrise.
  • U.S. Coast Guard approved life vests or jackets must be worn by all skiers and tubers.
  • An orange safety flag (12”x12”) must be displayed by a passenger/observer at all times when a skier or tuber is down in the water, or if an object other than a skier or tuber is being towed.  This flag is NOT to be permanently mounted on the watercraft.
  • The tow rope shall be retrieved unless returning to pick up a downed skier or tuber.

Swimming

 

  •  Swimming at your own risk is permitted in cove areas and no wake zones only, 7 days a week.
  • Excluding holidays, swimming at your own risk during daylight hours is permitted in the main channel, Monday through Friday only..

Littering

 

1. Littering into or on any of the lakes or their shorelines or adjoining common areas is prohibited and will be strictly enforced following Indiana DNR guidelines.

Personal Watercraft

 

  • Personal watercraft will be operated under the same regulations, including speed limits, as other watercraft unless otherwise specified herein.
  • Personal watercraft will operate only between the hours of sunrise and sunset.
  • No towing of skiers or tubers is allowed.
  • Maximum horsepower allowed is seventy-two (72).
  • Life vests must be worn by all persons on the personal watercraft during operation
  • Do not follow closer than two hundred (200) feet in the wake of the watercraft ahead.
  • Riding of any kind that may be construed as reckless is prohibited.  This includes, but is not limited to, sitting on the bow or front of the craft forward of the handles, persons hanging onto the stern or gunwales, and standing or riding backwards.
  • An operator shall not maneuver the craft in such a way as might throw riders

or the operator, or capsize the boat.

9.  A person operating a personal watercraft equipped by the manufacturer with a lanyard-type engine cutoff switch must attach such lanyard to his/her person, clothing, or personal flotation device as appropriate for the specific vessel.

 

Violation Penalties

 

  • After January 1st of each year, any unregistered craft on the lakes will lose lake privileges until the watercraft is registered at the Association’s Office, and the watercraft must be removed from the water.  A $25.00 fee will be paid for late registration (See Rule 1 Page 2).

2. There will be a zero tolerance alcohol policy enforced towards minors.

3. Police reports must be completed for all damage causing collisions or accidents.

            (A) Violation of any of the rules and regulations as set forth herein during any one violation period of one year, shall be subject to the following penalties:

(1) First violation – warning.

(2) Second violation – citation and $25.00 fine.

(3) Third violation – citation and $50.00 fine and loss of
     privileges (water craft must be removed from the lake) – 1 month.

(4) Fourth violation – citation and $100.00 fine and loss of
     privileges (water craft must be removed from the lake) – rest of year.

            (B) Violation of any of the rules and regulations as set forth herein during any consecutive year, shall be subject to the following penalty:

(5) Fifth violation – citation and $250.00 fine and loss of
     privileges (water craft must be removed from the lake) – for life.

(C) In addition to the penalties provided herein for the violation of specific rules set forth herein, the penalties imposed by the State of Indiana for the violation of any State law, rule or regulation, or any applicable DNR rules or regulations shall also apply as may be appropriate.

Lake Patrol

                 
      Although Christmas Lake Village’s three lakes are not “public waters” as defined in I. C. 14-8-2-226, as of the date that these Rules and Regulations are approved, these lakes will be made open to appropriate enforcement and patrol officers who posses enforcement powers granted to them by the State of Indiana, thereby making all Indiana watercraft statutes, I. C. 14-15 et seq. and State rules and regulations and certain applicable DNR rules and regulations fully enforceable on this private lake property.  Provided, however, nothing therein shall be construed as opening the properties to the public.

 

Enforcement

Rules and Regulations set forth herein are to be enforced by a duly authorized patrol.  Patrol may use a radar gun, Breathalyzer, digital camera, cellular telephone or police radio as necessary to properly enforce the rules and maintain order on the lakes.  Patrol shall have the authority to issue warnings and citations subject to review and appeal as set forth below

 

Appeals

(A) Appeal able to a hearing examiner selected from a 3 person panel, selected by the board within seven (7) days of request for appeal.

(B) May appeal hearing examiner’s decision to full Board or 3 person panel selected by Board within five (5) days of request for appeal.

 

FISHING REGULATIONS AND CATCH LIMITS

Limits and Restrictions-Per Angler/Per Day

Blue Gill – Maximum of 25 fish.  Harvest only those fish over 7 inches.
Red Ear Sun Fish - Maximum of 25 fish.  Harvest only those fish over 7”.
Largemouth Bass- Harvest all of these bass that are less than 12”.  Release all largemouth between 12 and 16”.  Angler may have no more than one fish in excess of 16” in their possession.
Hybrid Bass- Maximum of 12, no more than two may exceed 17 inches.
Crappie- 25
Catfish-10

 

GENERAL RULES

  • Your adherence to these rules will improve our fishery.
  • Remember that all fingers/coves are “No Wake”.
  • We do not allow float or jug fishing.
  • Ice fishing is allowed.  Holes for ice fishing are not to be more than 12” in diameter.  BE CAREFUL!
  • Any CLV employee may review an angler’s daily catch.
  • No fishing license is required for a member or guest.
  • “Visiting” boats are not allowed.
  • The Association will consider stocking fish on an annual basis
  • The Association will consider a professional fish survey as indicated by need.

 

BRUSH CHIPPING PROGRAM

SERVICES

•  Two free yard debris pick-ups per year - a period in the spring and fall will be specified for general yard debris chipping. Residents will be notified when we will be in their neighborhood. This scheduled pick up is free to members.
•  Free storm damage assistance - In order to receive free storm damage assistance, requests must be made within 48 hours of the storm. A National Weather Service Severe Storm warning or tornado warning is required to qualify for storm damage.
•  Christmas Trees- We will designate a drop off site, and 2 days in January when Christmas trees may be dropped off . For 2006 this will be January 7 th and 14 th .

PARAMETERS

•  There will not be a central drop point (except for Christmas trees). We will take the chipper to the work.
•  Unless we are specifically notified to leave the mulch, we will remove the chips from the premises.
•  This service is for yard maintenance and storm damage only. It is not intended for lot clearing, contractor refuse, or discarded landscaping materials.
•  Road clearing will receive storm damage priority.
•  We will only chip natural plant matter.
•  The maximum size will be 9" in diameter by 6' in length.
•  All refuse must be within 4'feet of the road, stacked with the largest cut end toward the street.
•  One of the primary uses of this machine is for right-of-way maintenance.


HOLLY PARK RULES

 

1. HOURS:  The park opens at daylight and closes at 10:00 PM.

2. DISORDERLY CONDUCT AND OFFENSIVE LANGUAGE ARE PROHIBITED.

3. Shelter House use is on a first come, first served basis.

4. Fires are allowed in designated areas only.

5. Picnic tables are not to leave the sheltered area except for Association events.

6. Skateboarders must defer to basketball players

7. Tennis is the only game to be played on the tennis courts

8. Please limit tennis to 60 minutes when people are waiting to play

9. Vehicles are restricted to designated parking areas only, unless otherwise directed.

10. No dumping or littering on park property.

11. All pets must be on a leash or tether at all times.

12. Clean up after your pet.

13. No weapons or firearms are allowed on park property.

14. Vandalism is against the law and prohibited.

15.  Fireworks are prohibited unless approved in writing by the Board of Directors.

There is a maximum of 30 days on fines.  After 30 days, the Association will take
steps to remedy the infraction.  The cost of the remedy will be added to the fines.  Fines and/or remedy costs that have not been paid in 90 days will become a lien on the property.

SWIMMING AND DIVING ARE AT YOUR OWN RISK

SWIMMERS MUST OBEY ALL INSTRUCTIONS GIVEN BY THE   LIFEGUARD PERTAINING TO WATER SAFETY OR THE POSTED RULES.  THE LIFEGUARD HAS THE AUTHORITY TO DISMISS ANYONE NOT OBEYING THESE INSTRUCTIONS AND/OR POLICIES.

ONLY AUTHORIZED PERSONS, LIFEGUARDS OR ANYONE RECEIVING FIRST AID ARE ALLOWED IN THE LIFEGUARD ROOM.

 

    Beach Hours
The beach operates daily from 1:00 PM to 8:00 PM beginning Memorial Day   Weekend until school begins, as well as Labor Day weekend. 

    Beach and Picnic Area Policies
     1.   No picnicking on the beach.

  1.      2.   No cans or bottles are allowed on the beach. Plastic beverage containers only.
  2.      3.   Fires are permitted in the grills only.
  3.      4.   CHILDREN UNDER AGE 13 MUST BE ACCOMPANIED AND             
  4.            SUPERVISED BY A RESPONSIBLE PERSON 13 YEARS OF AGE, OR
  5.            OLDER AT ALL TIMES.
  6. Alcoholic Beverages are not allowed on the sand or water portions of the

recreation area.

  1. Pets are not allowed on the beach at any time
  2. Anyone destroying, defacing, disfiguring, injuring or damaging Association property will be prosecuted to the fullest extent of the law.
  3. Inappropriate language or behavior will result in being dismissed from the beach.

    Swimming Policies While In The Water

  1.        1.  No floats, innertubes, frisbees, balls, or fins are permitted on the deep side of the    
  2.             ropes.
  3.       2.  No food or gum are allowed in the water.
  4.       3.  Do not hang from the diving boards.
  5.       4.  No hanging or pulling on ropes.
  6.       5.  Those that are unable to swim to the pier alone and unaided by flotation devices     
  7.            may not go to the pier.
  8.       6.  Only one person diving off the boards at a time.
  9.       7.  Divers must dive or jump off from the front of the boards.
  10.       8.  Divers must wait until people are out of the way before jumping or diving

           from the diving boards.

  1.       9.  There is no swimming under the pier.

    10.  Enter the water from the beach area only.
    11. The Lifeguards will clear the swim area if thunder is heard or weather warnings
           warrant a decision by the Lifeguards.
   
Lifeguards receive breaks at 3:30PM-3:45PM and 5:30PM-5:45PM.  THERE IS NO SWIMMING DURING THIS TIME. 

 

Back Gate Card Access Program

Rules and Regulation

 

  1. Members/owners of Christmas Lake Village, whose assessments are current on all lots owned and have no outstanding fees or fines owed to the Village, are eligible to obtain electronic swipe cards (back gate cards) that operate the electric gates at the South end of Balthazar Drive onto Clubhouse Road (back gate). 
  2. Applications for and renewal of cards are to be made at the main gate house.
  3. The back gate cards will only be issued or renewed for owner’s vehicles registered with CLV that have up to date valid CLV stickers. 
  4. The number of back gate cards issued to any one owner will not exceed the number of vehicles that have been registered for that owner for that year.
  5. The initial fee per back gate card is $25.00 each.
  6. Back gate cards are to be renewed annually between January 1 and March 31.  The member/owner must pay all annual maintenance fees prior to being entitled to renew his/her back gate cards. 
  7. If paid prior to April 1st, the renewal fee is $10.00/ea Renewals paid after April 1 will be charged $20.00 each.
  8. Lost cards will be deactivated upon notification of the loss to the Association. Replacement cards will not be activated until the control number of the lost card is determined.  The cost of a replacement cards is $25.00.
  9. A dated receipt for payment, including the current regulations, will be provided by the Association on each renewal.  The Association will maintain a copy for its records. 
  10. Back gate cards are not transferable.  Cards are not to be used by anyone other than the registered user.
  11. CLV cannot be held responsible for damaged cards.
  12. The back gate is not to be used for deliveries or other commercial ingress or egress.
  13. Towed trailers of any sort  - i.e. Utility, Watercraft, etc; busses; Recreational Vehicles; and/or vehicles in excess of 9200 pounds GVW are prohibited from using the back gate.
  14. Violation of back gate rules will result in loss of back gate privileges.  The owner will be notified and the owner’s cards will be rendered inoperable.

 

***The incoming gate is on a timer NOT an electrical loop.  The gate WILL close at the prescribed interval of TIME intended to allow only a single passenger vehicle through before closing.  Do Not hesitate or follow another car through the gate!   Damages to the gate and/or personal vehicle entering the Village incorrectly are the obligations of the vehicle owner to which the offending back gate card is issued.
